Important: Smidge is not medical or mental-health care

Smidge is a behavioral coach. It is NOT therapy, medical care, a medical device, or a substitute for professional help. Smidge does not diagnose, treat, or provide medical or mental-health advice. Do not use Smidge in place of care from a qualified professional.

If you are in crisis or thinking about harming yourself, contact emergency services or a crisis line immediately. In the United States, you can call or text 988to reach the Suicide & Crisis Lifeline. For any medical concern, consult a qualified healthcare professional.

Eligibility

Smidge is not directed to children under 13, and you must be old enough to form a binding agreement in your jurisdiction to use it.

Your account and use of the service

You can use Smidge without an account in local-only mode. If you create an account, you are responsible for maintaining the security of your credentials and for activity under your account. You agree to use Smidge only for lawful purposes and not to misuse, disrupt, or attempt to gain unauthorized access to the service.

Privacy

Your use of Smidge is also governed by our Privacy Policy, which describes what data we handle and the controls available to you, including account deletion and consent withdrawal.

Subscriptions and billing

Smidge may offer paid tiers. When paid subscriptions are offered through the iOS app, they are billed through your Apple App Store account, and Apple’s terms govern payment, renewal, and cancellation. Subscriptions renew automatically unless canceled, and you can manage or cancel them in your App Store account settings.

Intellectual property

Smidge, including its software, content, and branding, is owned by Lume Systems LLC and protected by applicable law. We grant you a limited, non-exclusive, non-transferable, revocable license to use Smidge for your personal, non-commercial use in accordance with these Terms.

Disclaimers

Smidge is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that any coaching output is suitable for your particular circumstances.

Limitation of liability

To the fullest extent permitted by law, Lume Systems LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or inability to use Smidge.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of Smidge after changes take effect constitutes acceptance of the updated Terms.
